On the Job Injury

If you are injured on the job, in the state of Indiana you may be entitled to worker’s compensation benefits. Worker’s compensation is a no fault law which provides benefits to injured workers regardless of whether the worker was at fault in causing the accident or whether the employer was at fault in injuring the injured worker. Generally speaking, worker’s compensation pays an injured worker lost wages at a rate of 66 2/3% of the injured worker’s average weekly wage, medical expenses if the worker obtains medical care at the facility selected by the employer (or the employer’s worker’s compensation insurance carrier) and a settlement if the injured worker’s injury is deemed permanent by a physician. Other benefits are available under the worker’s compensation act including future medical care. Future medical care is not available in all case and consultation with an attorney may assist the injured worker in determining whether or not the injured worker is a candidate for future medical care.
